The Return to Duty Process

The Return-to-Duty (RTD) process is required for safety-sensitive employees who violate DOT drug and alcohol regulations under 49 CFR Part 40.

1. Immediate Removal – Employees who test positive or violate DOT rules are removed from safety-sensitive duties.

2. SAP Evaluation – A DOT-qualified Substance Abuse Professional (SAP) assesses the employee and recommends treatment or education.

3. Treatment Completion – The employee must complete SAP-required programs.

4. Follow-Up SAP Evaluation – The SAP re-evaluates and, if compliant, clears the employee for testing.

5. Return-to-Duty Test – The employee must pass a directly observed DOT drug and/or alcohol test.

6. Follow-Up Testing – A minimum of 6 unannounced tests in the first 12 months, up to 5 years if required.

Remember: The SAP clears the employee, but the employer decides whether to keep the employee.
