Any DOT-regulated employee who violates DOT drug and alcohol testing rules must complete the return-to-duty process before performing safety-sensitive work again.
This may include CDL/CLP drivers, pilots, transit workers, railroad employees, pipeline employees, maritime employees, and other employees covered under DOT drug and alcohol testing rules.

After you complete the required education and/or treatment, you must return to the SAP for a follow-up evaluation.
During the follow-up evaluation, the SAP determines whether you successfully complied with the recommendation. If you did, the SAP provides written documentation to the employer or DER, and you may move forward to the return-to-duty testing step if the employer chooses to continue the process.

No. The return-to-duty test cannot be completed before the SAP determines that you successfully complied with the SAP’s education and/or treatment recommendation.
The return-to-duty test is not the first step. It comes after the SAP follow-up evaluation.

DOT rules require at least six unannounced follow-up tests during the first 12 months after returning to safety-sensitive duty. The SAP may require more tests and may extend follow-up testing for up to 60 months, depending on the case.
The employee should not be given the full follow-up testing schedule in advance.

The employer is responsible for carrying out the SAP’s follow-up testing plan. A C/TPA may help coordinate testing, scheduling, tracking, and record organization, but the employer remains responsible for compliance.
For owner-operators, C/TPA support is especially important because they must manage testing requirements through the proper compliance structure.

The employer is responsible for making sure the employee does not perform safety-sensitive duties until the return-to-duty process is complete.
The employer receives SAP reports, makes the final return-to-duty decision, arranges the return-to-duty test when appropriate, and carries out the SAP’s follow-up testing plan after the employee returns to duty.

No. The SAP determines whether the employee has successfully complied with the SAP’s recommendation and is eligible to move forward in the return-to-duty process.
The employer decides whether to return the employee to safety-sensitive work.

After the return-to-duty test is completed with the required result, the owner-operator moves into Step 6 follow-up testing.
The SAP’s follow-up testing plan must be followed, and testing must be unannounced. C/TPA support may help with coordination and compliance tracking.
